1. What they apply to
These terms govern the services sold by TDomeza SARL (see the legal notice) under the names TD ViaField, TD Agency and TD Tech. If these terms and the accepted quote differ, the quote prevails.
The Sarréh and TD Edu apps have their own terms of use.
2. The quote and the order
Every service starts with a conversation, then a written quote stating what will be done, the price, the timeline and the payment terms. The order is firm once you accept the quote in writing, by email or WhatsApp, and the payment set out in the quote has been received.
3. Prices
Prices are stated on the quote, in CFA francs or euros. They always separate our fees from the expenses incurred on your behalf (travel, administrative costs, cleaning, repairs, advertising budget, purchases). An expense not provided for in the quote is only incurred with your agreement.
4. Payment
- TD ViaField: the mission is paid before it is carried out; a subscription is paid at the start of each month.
- TD Agency: each month is paid in advance. A quarter or half-year paid in advance gives a 10% or 15% discount.
- TD Tech: according to the payment schedule in the quote, usually a deposit on ordering followed by payments at each stage.
Payment methods: Orange Money, and bank transfer on request. Late payment may suspend the service after a reminder left unanswered for 8 days.
5. How we deliver the service
We commit to delivering the service with care, within the timeline of the quote, and to keeping you informed at every stage through a single point of contact. Our obligation is one of means.
To succeed, we need you: accurate information, the necessary access and documents, and your approvals within the agreed timeframes. Any delay on your side delays our timeline accordingly.
6. Rules specific to TD ViaField
The TD ViaField report is a statement of findings: it describes what our team saw on site, on the date of the visit, with dated and geotagged photos and videos. It is not a technical survey, a legal check of a land title, or a guarantee of a property's value. For those questions, we can coordinate a notary, surveyor or engineer, billed separately.
Administrative errands are carried out under a written power of attorney when the procedure requires it. Every report is issued and signed by TDomeza SARL.
7. Rules specific to TD Agency
Monthly plans commit you for 3 months, then continue month to month with one month's notice. Changing plans is free and takes effect the following month. The advertising budget is not included and remains paid by you, directly to the platforms or through us as set out in the quote. We only publish content you have approved.
8. Rules specific to TD Tech
Once the service is fully paid, the code developed for you, the delivered content and the domain name belong to you. The domain name is registered in your name. Maintenance is optional and offered as a monthly subscription.
9. Cancellation and right of withdrawal
You may cancel a service before it starts; expenses already incurred on your behalf remain due. A TD ViaField mission cancelled less than 24 hours before the visit may be partly billed, as set out in the quote.
If you are a consumer living in the European Union, you have 14 days after accepting the quote to withdraw, without giving a reason. If you ask us to start before that period ends, you pay for the part of the service already delivered, and you lose this right once the service has been fully delivered.
10. Liability
We can only be held liable for direct damage caused by a proven fault on our part, up to the amount paid for the service concerned. We are not liable for decisions you take based on a statement of findings, nor for events beyond our control (bad weather, unrest, refused access to the site).
11. Your data
The data needed for the service is processed as described in our privacy policy. We keep the information you entrust to us confidential.
12. Complaints and disputes
For any complaint, write to contact@tdomeza.com: we answer within 8 working days and first look for an amicable solution. These terms are governed by Cameroonian law and, failing agreement, the courts of Douala have jurisdiction. If you are a consumer living in the European Union, you keep the protection granted to you by the mandatory rules of the country where you live.
